Deferment from mobilization will remain during reissuance: Cabinet of Ministers amends rules

Military-liable persons will be able to resubmit an existing mobilization deferment on another legal basis without losing protection while documents are under consideration. The Cabinet of Ministers of Ukraine approved the relevant changes.

The new procedure will apply when a person, after receiving a deferment, becomes eligible for another ground under Article 23 of the Law on Mobilization. For example, a military-liable person has a deferment due to studies but later has a third child or becomes a caregiver for a relative.

While the commission reviews the resubmission application, the previous deferment will remain valid. Exceptions are cases where the deferment is subject to cancellation for other reasons stipulated by law.

If the commission approves the application, the old deferment will be annulled only after the new data is entered into the "Oberig" register. In case of refusal, the previous deferment remains in effect until the end of its established term.

How to apply and how long it will be considered

An application for granting or resubmitting a deferment can be submitted through a Center for Administrative Services (CNAP) using the "Diia" portal tools. The system will automatically check whether the applicant is registered for military service and whether they have an active deferment.

The commission must review the application within seven working days from the date of its registration. If a verification requires inquiries to other state bodies, the deadline may be extended, but not more than up to 15 working days.

Until a decision is made, the applicant will not be sent for a medical examination by a military medical commission. After a positive decision, the information about the new deferment must be entered into the "Oberig" register within one calendar day.

The system will not generate an application if the person is not registered for military service or already has an active deferment. Exceptions are provided for resubmission, as well as cases when the current deferment expires in less than 30 days.

The government also clarified the rules for granting deferments for reserved employees, civil servants, and certain officials, as well as the procedure for entering relevant data into the register.
