The Antimonopoly Committee imposed nearly UAH 6 billion in fines, but collected only 1.7%

In 2025, the Antimonopoly Committee of Ukraine adopted 1,238 decisions to impose fines totaling UAH 5.9 billion. The violators actually paid only UAH 96.8 million, or 1.7% of the imposed amount. This was stated in the analysis of the AMCU annual report conducted by the Accounting Chamber.

The bulk of imposed fines relates to a single decision: namely UAH 4.8 billion, or 82% of the total. The Accounting Chamber's statement does not specify which specific case this decision concerned.

The low collection rate is partly due to litigation. Fining decisions totaling UAH 5.1 billion, which is 87.1% of the total amount, are being challenged in court.

As of December 31, 2025, the total debt for fines and penalties imposed by AMCU decisions reached UAH 19.8 billion. Over the year, it increased by 30.5%.

This amount does not include an additional UAH 644.7 million in debt from decisions of the interregional territorial offices of the Committee. About 93% of the total debt is at the stage of judicial appeal or enforcement proceedings.

The Accounting Chamber noted that the AMCU annual report mainly contains quantitative performance indicators but does not allow for a full assessment of the impact of the agency's activities on the state budget. In particular, the document lacks consolidated data on court-overturned decisions, amounts of canceled fines, and related fiscal risks.

The auditors also did not confirm the UAH 3.1 billion in economic effect claimed by the AMCU. The Accounting Chamber believes the methodology employed is not based on objective indicators and does not link the Committee's performance to budget revenues or expenditures.

It was recommended that the Cabinet of Ministers instruct the Ministry of Justice to analyze the reasons for the prolonged non-enforcement of AMCU decisions and to improve the mechanisms for collecting fines. The Committee itself should strengthen monitoring of decisions enforcement and more comprehensively reflect their budget impact.
