The NBU will check Sense Bank following new NABU materials - Pyshnyi in Parliament
The supervisory board of the state-owned Sense Bank currently lacks a quorum and is not competent. The National Bank of Ukraine has simultaneously started an assessment of the collective suitability of the entire board and assigned unscheduled inspections of the bank following the publication of new materials by the National Anti-Corruption Bureau (NABU).
The head of the NBU, Andrii Pyshnyi, announced this on August 20 during a speech in the Verkhovna Rada.
According to him, the National Bank has opened administrative proceedings to assess the collective suitability of the entire supervisory board of Sense Bank. The grounds included, in particular, the materials of the anti-corruption investigation published by NABU the day before.
Pyshnyi stated that these materials give the NBU grounds to consider the previous recusal of the chairman of the supervisory board, Mykola Hladyshenka, as formal. According to the regulator's assessment, he actually continued to influence the bank's activities, while the supervisory board itself responded inadequately to the situation.
"The National Bank will determine the consequences that will personally apply to the entire composition of the supervisory board and will be addressed to the shareholder for proper response", - said Pyshnyi.
Supervisory board lost quorum
Separately, the head of the NBU noted that following the latest decisions, the supervisory board of Sense Bank can no longer function fully.
"The supervisory board of Sense Bank lacks a quorum today. The supervisory board is not competent", - said Pyshnyi.
He called such a situation unacceptable for a state-owned bank and called on the state as the owner to urgently complete the supervisory board.
This concerns the appointment of new state representatives to its composition: from the Cabinet of Ministers and from the relevant committee of the Verkhovna Rada. The supervisory board, among other things, is responsible for overseeing the activities of the management board and making certain strategic personnel and managerial decisions.
Earlier, Kurs.com.ua reported that the NBU recognized Mykola Hladyshenka as not meeting the independence requirements and demanded that the government terminate his powers on the supervisory board of Sense Bank.
The NBU will conduct unscheduled inspections of the bank
Another consequence of the new NABU materials was the decision of the National Bank to conduct unscheduled inspections of Sense Bank.
Pyshnyi noted that the regulator must establish all the circumstances set out in the published materials and will continue cooperation with law enforcement agencies.
The head of the NBU also said that from the published conversations it follows that the persons involved were looking for ways to bypass the control mechanisms established by the bank and the regulator. According to Pyshnyi, this indicates that the financial monitoring measures created obstacles for them.
At the same time, final conclusions regarding possible violations must be made based on the results of inspections and other procedures provided by law.
