Eco-industrial parks to appear in Ukraine: main changes
The Verkhovna Rada has passed in its entirety bill No. 12117, which simplifies the creation and operation of industrial parks, expands the list of permitted activities therein and introduces the status of an eco-industrial park. 270 MPs voted for the document.
The law aims to remove a number of limitations that arose during the practical application of existing legislation on industrial parks. During its preparation, the relevant parliamentary committee held consultations with market participants and visited over 20 operating parks.
One of the changes will be the abolition of the upper limit on the area of an industrial park, which previously stood at 1,000 hectares. At the same time, the law improves procedures for increasing and decreasing the territory of already established parks.
Eco-industrial parks to appear
The document introduces the concept of an eco-industrial park. This should allow for the creation of industrial sites focused on more efficient use of resources, energy and industrial infrastructure.
The criteria that such parks must meet to obtain the appropriate status will be determined by the Cabinet of Ministers.
Also, the functions of industrial park participants are more clearly delineated. The initiator of its creation will be able to simultaneously perform the functions of a management company without the need to create a separate legal entity for this purpose.
More energy facilities allowed in parks
The law expands the list of activities that industrial park participants may engage in. In particular, the possibility of own electricity generation is envisaged.
Energy storage systems and other alternative energy facilities may also be placed on park territories. In addition to production infrastructure, the law regulates the placement of training centers, food service establishments and other auxiliary facilities.
Separately, the procedures for transferring ownership of land plots within an industrial park, changing its area, as well as including and excluding parks from the relevant register are improved.
Management companies get access to “5-7-9%”
Management companies of industrial parks will be able to use the state program of preferential lending “Affordable Loans 5-7-9%”. This should expand opportunities for attracting financing for the development of industrial site infrastructure.
The law also sets requirements for separate accounting of various types of activities of business entities, transparency of financial relations and disclosure of information on the use of public funds.
The Verkhovna Rada notes that the changes should simplify the creation of new production facilities, attract investment and develop industrial infrastructure within the “Made in Ukraine” policy.
Bill No. 12117 was registered in October 2024, and in first reading parliament supported it in February 2025. After adoption in its entirety, the document is being prepared for signing.
