The State Restoration Agency is challenging the payment of over one billion hryvnias to Turkish Onur for road repairs
The State Agency for Restoration and Development of Infrastructure of Ukraine has appealed to the Supreme Court, trying to challenge decisions under which the Turkish company Onur must be paid UAH 1.09 billion for work on the M-05 Kyiv-Odesa highway. The Supreme Court has opened cassation proceedings, and the hearing is scheduled for September 23.
This is reported by "Nashi Groshi" with reference to the ruling in the State Register of Court Decisions.
The dispute concerns a contract for the repair of several sections of the Kyiv-Odesa highway. In January 2020, the then Ukravtodor ordered work from Onur Taahhut Tasimacilik Insaat Ticaret Ve Sanayi A.Ş. following a tender worth EUR 65 million.
The procurement was conducted outside the Prozorro system because the project was financed by loan funds from the European Bank for Reconstruction and Development and the European Investment Bank.
About six months later, the EBRD notified the Ministry of Finance of the suspension of financing for the contract pending an investigation into possible violations during the bidding. In October 2020, the EBRD cancelled the contract financing, and in February 2021, the European Investment Bank did so.
At that time, Onur, according to "Nashi Groshi", had already performed part of the work worth approximately EUR 11 million. After the financing was terminated, the company went to court demanding payment from Ukravtodor.
The court dispute has been going on for several years
In 2024, the Commercial Court of Kyiv granted Onur's claim and ruled to recover UAH 1.09 billion from the State Restoration Agency. The following year, the agency managed to win an appeal, but the Supreme Court sent the case for a new hearing.
During the retrial in July 2026, the Northern Commercial Court of Appeal again sided with Onur. After this, the State Restoration Agency filed a cassation appeal against the decisions of the first and appellate instances.
On September 7, the Supreme Court opened cassation proceedings. An open court hearing is scheduled for September 23.
The EBRD previously imposed sanctions on Onur
Separately, in May 2026, the EBRD announced a settlement with Onur in a case regarding collusion during a tender in Ukraine. According to "Nashi Groshi", it concerned precisely the procurement of work on the M-05 Kyiv-Odesa highway in 2020.
As a result of this settlement, Onur and 53 companies related to it were barred from participating in projects financed by the EBRD for one year and three months.
In addition, NABU and SAPO are investigating criminal proceedings regarding possible corruption by officials of Ukravtodor and representatives of the Turkish company during the implementation of road contracts. As "Nashi Groshi" notes, one of these episodes relates to the contract under which Onur is now seeking payment through the court.
