The Cabinet of Ministers of Ukraine has approved a draft law that will allow servicemen to register for housing at their place of service regardless of their registered place of residence. The new rules aim to eliminate a legal obstacle that prevents some servicemen from joining the queue for housing.

The Ministry of Defense of Ukraine reported this on October 13. Prime Minister Serhiy Koretskyi had previously announced the approval of the document.

The draft law provides that servicemen and members of their families who need improvement of housing conditions will be able to register for housing directly at their place of service. It will not matter where their place of residence is registered or declared.

Why servicemen cannot join the housing queue

The Ministry of Defense explained that the need for legislative changes arose due to a legal conflict related to the registration of servicemen's place of residence.

Previously, servicemen had the right to register their place of residence at the legal address of the military unit. This allowed them to register for housing at their place of service.

However, after the entry into force of the Law of Ukraine "On the Provision of Public (Electronic Public) Services for Declaration and Registration of Residence in Ukraine", this possibility was abolished.

At the same time, most servicemen do not have their own housing at their place of service where they could register. As a result, a situation arose where defenders who need improvement of housing conditions cannot complete housing registration at their place of service.

This problem is exactly what the new draft law aims to solve.

What the new rules provide

The Ministry of Defense proposes to amend Article 12 of the Law of Ukraine "On Social and Legal Protection of Servicemen and Members of Their Families".

The document is to enshrine the right of servicemen to join the queue for improvement of housing conditions directly at their place of service, without the need to change their official residence address.

Thus, a serviceman who is registered in one locality but serves in another will be able to apply for housing registration at their place of service, provided they meet other legal requirements.

An important clarification: the proposed changes will not apply to servicemen of the Security Service of Ukraine.

At the same time, the new mechanism concerns only the registration for housing. It does not provide for automatic provision of an apartment or monetary compensation after registration in the queue.

When the new rules will take effect

Currently, the Cabinet of Ministers has only approved the draft law and submitted it to the Verkhovna Rada.

For the proposed changes to take effect, the parliament must pass the law, and the president must sign it. After that, the new provisions will apply in accordance with the terms established by law.

Thus, as of October 13, the simplified procedure has not yet come into effect. The Ministry of Defense has not yet announced from what date servicemen will be able to register for housing under the new rules.

Previously, the government also approved a unified form of the warrant for service housing for servicemen, which is to unify documents for processing the respective residential premises.
