Koretskyi clarified rules for business operations during yellow alarm

Private enterprises that do not have their own shelter may continue to operate during a yellow level air threat only with the consent of the labor collective. If employees have not given such consent, the employer cannot force them to work.

Prime Minister Sergii Koretskyi stated this in an interview with the program "TSN.Week".

"We have provided an opportunity for an entrepreneur or businessman to continue operating during a yellow level with the consent of the labor collective. And if the labor collective has not given such consent, then he cannot operate, because there is no need to force people", said Koretskyi.

This rule applies primarily to enterprises where there is no temporary or permanent shelter. The current Cabinet of Ministers Resolution No. 1092 allows such companies to operate with the consent of the labor collective until a protective room is arranged, but no longer than three months from the entry into force of the resolution.

If the enterprise has proper shelter for personnel and visitors, the business may continue to operate during a yellow level. Visitors to establishments without shelters decide for themselves whether to remain there during such a threat.

A yellow level is introduced in the event of a drone threat. A red level means missile, missile-drone, or mass drone attack. During a red level, rules are much stricter and include the cessation of work and movement of people to shelters. The government announced the new system in early September, explaining its necessity to simultaneously maintain the operation of the economy and preserve people's safety. 

Koretskyi also reported that the Cabinet of Ministers already receives many signals about violations of the new rules. According to him, the government responds to such cases and plans to further adjust the system depending on the practice of its application.

"I have many signals about violations, and we tactically influence certain enterprises", said the prime minister.

He added that the new system does not eliminate the danger of Russian attacks. Its goal is to enable enterprises, transport, and other institutions to continue operating at a lower threat level without halting economic activity for many hours due to long drone attacks.
