The Infrastructure Restoration and Development Service in Chernivtsi Oblast changed the terms of two large tenders for the maintenance of state highways following complaints from the Avtostrada company to the Antimonopoly Committee of Ukraine. The total expected cost of the procurements is UAH 1.77 billion excluding VAT.
The publication "Nashi Hroshi" reported this on October 22, citing documents in the Prozorro system.
These are two tenders announced on September 23, with an expected value of UAH 1.23 billion and UAH 541.63 million. They provide for the operational maintenance of state roads in Chernivtsi Oblast until April 30, 2029.
LLC "Group of Companies "Avtostrada" appealed the terms of both procurements on October 5. The company believed that certain qualification requirements unreasonably restricted its ability to participate in the bidding.
Dispute over asphalt plant requirements
Avtostrada's main objection concerned the mandatory certification of the asphalt plant that the participant plans to use for road works.
The customer required that the plant comply, in particular, with DSTU 9290-5:2024 regarding the production of stone-mastic asphalt mixtures.
To participate in the procurements, Avtostrada planned to engage the enterprise PE "Avtomahistral" under an asphalt supply contract. Its plant had certification under a number of other state standards, but not DSTU 9290-5:2024.
In the complaint, the company noted that the works provided for by the tenders do not include the laying of stone-mastic asphalt. Therefore, it considered the requirement for the respective certification excessive.
The Restoration Service reported that already on October 7 it crossed out the disputed standard from the tender documentation. However, the Antimonopoly Committee drew attention that public procurement legislation does not provide for amendments to the documentation by simply striking through the text.
In addition, the customer failed to properly justify the need to certify the plant precisely under this standard.
On October 14, the AMCU commission made a decision based on the complaints, and on October 19, the Restoration Service officially adjusted the documentation of both tenders. The disputed requirement was removed from the new versions of the documents with the proper formatting of the list of changes.
Not all of Avtostrada's requirements were upheld
The company also challenged the requirements for experience in performing certain types of road works.
In particular, participants had to confirm previous performance of manual sprinkling of roads with anti-icing materials, as well as cutting and shredding bushes using specialized equipment.
Avtostrada claimed to have significant experience in highway maintenance, but its previous customers did not need exactly such services.
The Restoration Service objected, explaining that in the mountainous areas of Bukovyna manual sprinkling is necessary at bus stops, intersections and dangerous sections where the use of large road machinery may be difficult. The customer justified bush removal by the need to maintain proper visibility on the roads.
In this part, the Antimonopoly Committee did not uphold the complainant. The commission concluded that the company had not provided sufficient evidence to mandate changes to the specified requirements.
Thus, Avtostrada succeeded in getting the requirement for asphalt plant certification reviewed, but not all of the challenged participant selection criteria.
The documentation change may expand the circle of companies capable of competing for large road contracts in Chernivtsi Oblast. At the same time, the AMCU decision does not mean Avtostrada's victory in the tenders or the conclusion of contracts with it. The procurements remain separate competitive procedures, based on the results of which contractors must be determined.
