The Commercial Court of Kyiv has granted two claims by specialized defense prosecutor's offices against private companies that violated the terms of state contracts. According to court decisions, a total of 340 million UAH is to be recovered in favor of the state.

This was reported by the Prosecutor General's Office on November 3. The court issued the corresponding decisions on October 26 and 28, 2026.

The largest recovery is related to an unfulfilled contract of the Ministry of Defense of Ukraine for the supply of weapons. In October 2022, the agency concluded a contract with a private company that received 1.3 billion UAH in prepayment. However, the supplier failed to fulfill its obligations and did not return the received funds in a timely manner.

The specialized defense prosecutor's office of the Prosecutor General's Office filed a lawsuit demanding the recovery of 285.9 million UAH in inflationary losses and 3% annual interest for the delay in returning the prepayment. On October 28, the Commercial Court of Kyiv granted this claim in full.

The second dispute concerned a contract for the needs of the National Guard of Ukraine. A private company failed to return the unused portion of the prepayment and did not pay the appropriate financial charges.

On October 26, the court granted the claim of the Dnipro specialized defense prosecutor's office of the Eastern region for the recovery of 54.1 million UAH. This amount includes the unreturned prepayment, interest, and penalty sanctions.

Thus, the total amount of recoveries under the two court decisions is 340 million UAH. At the same time, a decision to recover does not mean actual return of funds to the state. The Prosecutor General's Office has not reported on the implementation of these decisions as of now.

The prosecutor's office emphasized that it continues to work on protecting the state's financial interests in defense procurement. The names of the private companies against which court decisions have been made are not disclosed in the statement.
