The Cabinet of Ministers of Ukraine has published Resolution No. 1328 dated October 23, 2026, which changes the procedure for reserving conscripted employees. The document provides for a reduction in the standard reservation quota for defense industry and energy enterprises, a revision of the criteria for critical enterprises, and increased control over the granting of deferments.
The corresponding Resolution of the Cabinet of Ministers No. 1328 appeared on the government portal on October 26. The Government adopted it on October 23, but until publication the document underwent final technical processing.
One of the main changes is the reduction of the standard limit for reserving employees of the defense-industrial and fuel-energy complexes from 100% to 95%.
The restriction applies to defense industry enterprises recognized as critically important by the Ministry of Defense, as well as to relevant energy enterprises, contracting organizations, and domestic manufacturers of transformer equipment.
At the same time, the resolution provides for an important exception: all conscripted employees directly involved in the production processes of critical enterprises are subject to mandatory reservation.
Thus, the reduction of the quota should primarily affect auxiliary and service personnel, not specialists who ensure the production of weapons, the fulfillment of defense contracts, and the operation of energy infrastructure.
Enterprises will also be able to reserve more than 95% of conscripted employees, including 100%, but this will require separate approval. The corresponding decision can be made by the Ministry of Defense or the Ministry of Energy taking into account the agreed recommendations of the new Coordination Center for the Organization of Reservation.
A substantiated proposal to increase the limit must be submitted by the relevant ministry. One of the grounds for refusal may be systematic violations by the enterprise management of military registration legislation.
In particular, two or more documented violations over the past 12 months or the bringing of the manager to administrative liability for such violations are taken into account.
The resolution also provides for the establishment of a Coordination Center, which will consider requests for increasing quotas, coordinate criticality criteria, and provide recommendations regarding the review of the status of enterprises.
The usual period for consideration of requests shall not exceed one month. In urgent cases, recommendations must be provided within seven working days.
Another significant change concerns the existing statuses of critical enterprises. Central executive authorities and regional military administrations must, within ten days after the resolution enters into force, review sectoral and regional criticality criteria.
If an enterprise has received the corresponding status on the basis of a criterion that is subsequently excluded, the decision to recognize it as critical is subject to revocation.
At the same time, the new rules do not provide for the automatic cancellation of all previously granted statuses. Existing decisions remain in effect until the expiration of the established period, if there are no grounds for their revocation provided for by the resolution.
Previously agreed increased reservation limits may also be maintained during the transition period. For individual decisions adopted before December 8, 2025, a maximum validity period until December 8, 2026 is provided.
In addition, the resolution establishes additional restrictions for representative offices of donor organizations and executors of international technical assistance projects. The standard limit is no more than 50% of conscripts directly involved in the project, and no more than seven persons. Exceeding the numerical restriction is allowed by a separate decision subject to the established conditions.
The new rules will come into effect from the day of the official publication of the resolution. The posting of the document on the Cabinet's website on October 26 does not in itself confirm the occurrence of this date.
We would like to remind you that earlier Kurs.com.ua reported on the preparation of new reservation rules and the proposal of Prime Minister Serhiy Koretskyi to develop a separate mechanism for the full reservation of employees in exchange for enterprises fulfilling mobilization obligations.
This mechanism currently remains a concept and is not part of the current wording of Resolution No. 1328. The Government plans to coordinate its parameters with the Ministry of Defense, the Ministry of Economy, and employers by December 1, 2026.
