The National Bank of Ukraine plans to update the rules for organizing on-site inspections of payment system operators and other participants in the payment infrastructure. The regulator proposes to change the procedure for approving annual monitoring plans, as well as to review the grounds for their adjustment.

This was reported by the National Bank, which on October 26 published the corresponding draft resolution for public discussion.

The proposed changes relate to the oversight procedure - control over the reliability, continuity and security of the functioning of the payment infrastructure.

One of the main innovations is the transfer of authority to approve the annual plan of on-site monitoring to the Board of the NBU. Before making a decision, the plan must be agreed with the Committee for Supervision and Regulation of Banks, Oversight of Payment Infrastructure.

Currently, relevant plans are approved by an administrative act signed by an authorized curator. The proposed procedure provides for decision-making at the level of the Board of the National Bank.

At the same time, the annual plan, as before, must be approved by December 25 of the year preceding the monitoring.

Under what conditions the NBU will be able to change inspection plans

The draft resolution also clarifies the list of circumstances under which the regulator may review the already approved schedule of on-site monitoring.

In particular, changes are provided in cases of revocation of a license or exclusion of a company from the Register of Payment Infrastructure, changes in its performance indicators based on remote monitoring, conduct of an unscheduled inspection during the year, as well as the occurrence of restrictions or other circumstances that make planned on-site monitoring impossible.

The decision to adjust the annual plan will also be made by the Board of the NBU after approval by the relevant committee.

In addition, the regulator proposes to remove from the current regulation certain technical norms that regulate internal procedures for inspection planning. They will be determined by a separate administrative act of the National Bank.

Who will be affected by the changes

The new rules will apply to payment system operators, including non-residents, settlement banks, technological operators of payment services and payment system participants.

The National Bank explains the need for changes by reviewing approaches to risk-based inspection planning. It is expected that the updated procedures will help improve the reliability and continuity of Ukraine's payment infrastructure.

Currently, the proposed changes have not entered into force. The NBU accepts comments and proposals from market participants until November 4, 2026 inclusive.

The draft document provides for the resolution to enter into force on December 1, 2026, but the final date will depend on the adoption of the relevant decision by the regulator.
